1. Introduction & Agreement

Welcome to Maja Trading Card House, operated by Legend Entertainment ("we," "us," "our," or "the Company"). By accessing or using our website at majatcghouse.com, making a purchase, subscribing to any of our plans, visiting our physical retail location, or engaging with us on any third-party platform including Whatnot and TCGplayer, you agree to be legally bound by these Terms and Conditions ("Terms").

Please read these Terms carefully before using our services. If you do not agree with any part of these Terms, you must discontinue use of our website and services immediately. Your continued use of our website and services constitutes your ongoing acceptance of these Terms.

These Terms apply to all visitors, customers, subscribers, and any other users who access or use our services in any capacity.

2. Who May Use Our Services

2.1 Age Requirements

You must be at least 18 years of age to make a purchase, create an account, or subscribe to any plan offered by Maja Trading Card House. By using our services you represent and warrant that you are at least 18 years of age. If you are between the ages of 13 and 17, you may only use our services under the direct supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

We do not knowingly permit individuals under the age of 13 to use our services. If we discover that a user is under 13, we will immediately terminate their account and cancel any associated orders or subscriptions.

2.2 Eligibility

By using our services you represent and warrant that:

You are legally capable of entering into a binding contract
You are not prohibited from using our services under any applicable law
All information you provide to us is accurate, current, and complete
You will maintain the accuracy of your information and update it as necessary

3. Accounts

3.1 Account Creation

To access certain features of our website, make purchases, or subscribe to a plan, you may be required to create an account. When creating an account you agree to provide accurate and complete information including your full name, email address, and a valid payment method.

3.2 Account Responsibility

You are solely responsible for maintaining the confidentiality of your account credentials including your username and password. You are responsible for all activity that occurs under your account. You agree to notify us immediately at majatcghouse.com if you suspect any unauthorized use of your account or any security breach.

3.3 Account Termination

Maja Trading Card House reserves the right to suspend or terminate your account at any time without notice if we believe you have violated these Terms, engaged in fraudulent activity, or for any other reason at our sole discretion. Upon termination, your right to use our services will immediately cease.

4. Products & Services

4.1 Product Descriptions

Maja Trading Card House makes every effort to accurately describe and represent our products including Magic: The Gathering singles, sealed product, booster boxes, commander precons, and TCG accessories. However we do not warrant that product descriptions, images, pricing, or other content on our website is completely accurate, complete, or error-free.

4.2 Pricing

All prices are listed in United States Dollars (USD). Prices are subject to change at any time without prior notice. We reserve the right to correct pricing errors. If a product is listed at an incorrect price due to a typographical or system error, we reserve the right to cancel any orders placed at the incorrect price and notify you of the correction.

4.3 Product Availability

All products are subject to availability. Maja Trading Card House reserves the right to limit quantities, discontinue products, or modify product offerings at any time without notice. Listing a product on our website does not guarantee its availability at the time of purchase.

4.4 Card Grading & Condition

Magic: The Gathering singles sold by Maja Trading Card House are graded according to our internal standards using the following scale: Near Mint (NM), Lightly Played (LP), Moderately Played (MP), Heavily Played (HP), and Damaged (DMG). Cards are not professionally graded by a third-party grading service unless explicitly stated in the product listing. Maja Trading Card House makes no warranties regarding card condition beyond our own internal assessment. Minor variations in condition assessment are inherent to the collectibles industry and do not constitute grounds for a refund unless the card is significantly misrepresented.

4.5 Card Values & Market Fluctuation

Magic: The Gathering card values fluctuate based on market conditions, tournament results, reprints, and other external factors. Any stated card values on our website, in our subscription boxes, or in our marketing materials reflect our good-faith assessment at the time of publication and are not a guarantee of future or current market value. Maja Trading Card House is not responsible for changes in card values after purchase.

4.6 Right to Modify Offerings

Maja Trading Card House and Legend Entertainment reserve the right to modify, suspend, or discontinue any product, service, subscription tier, or feature at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of services.

5. Orders & Purchases

5.1 Order Acceptance

Placing an order on majatcghouse.com, through Whatnot, or through TCGplayer constitutes an offer to purchase. Maja Trading Card House reserves the right to accept or decline any order at our sole discretion. An order is not confirmed until you receive an order confirmation from us.

5.2 Payment

All purchases must be paid in full at the time of order. We accept major credit cards, debit cards, and other payment methods as displayed at checkout. All payment information is processed securely through our payment processors. We do not store full payment card numbers on our servers.

5.3 Order Cancellations

Once an order has been placed and payment processed, cancellations are not guaranteed. If you wish to cancel an order, contact us immediately at majatcghouse.com. We will make reasonable efforts to accommodate cancellation requests if the order has not yet been packed or shipped. Orders that have already been handed to USPS cannot be cancelled.

5.4 Refused Orders

Maja Trading Card House reserves the right to refuse or cancel any order for any reason including but not limited to suspected fraud, pricing errors, product unavailability, or violations of these Terms.

6. Subscriptions

6.1 Subscription Plans

Maja Trading Card House currently offers three subscription plans: The Sealed Pack ($25.00/month), The Curator ($75.00/month), and the Collector's Club ($175.00/month). Each plan is governed by its individual Plan Policy in addition to these Terms.

6.2 Billing

All subscription plans are billed on the 1st of each month regardless of when you subscribe. If you subscribe at any point during the month your first charge will occur on the 1st of the following month. No subscription box will be prepared, packed, or shipped until payment has been successfully processed. Subscriptions automatically renew each month unless cancelled in accordance with Section 6.4.

6.3 Failed Payments

If your payment fails on the 1st of the month, your subscription will be placed on hold and no box will be fulfilled for that month. You will be notified of the failed payment and given the opportunity to update your payment method. If payment is not resolved within 5 business days, your subscription may be cancelled at our discretion. Maja Trading Card House is not responsible for boxes missed due to failed payments.

6.4 Cancellation

You may cancel your subscription at any time through your account portal. To avoid being charged on the 1st of the following month, cancellations must be submitted by 11:59 PM CST on the 28th of the current month. Cancellation stops future billing but does not entitle you to a refund for any period already billed. All subscription perks including VIP Whatnot access, reserved lots, and event entry are forfeited immediately upon cancellation.

6.5 Subscription Modifications

Maja Trading Card House reserves the right to modify subscription pricing, contents, perks, or terms at any time. We will provide reasonable notice of material changes via email. Your continued subscription following notice of changes constitutes your acceptance of the updated terms.

6.6 Collector's Club Enrollment Cap

The Collector's Club is a limited enrollment program. Maja Trading Card House reserves the right to cap enrollment at any time. Being placed on a waitlist does not constitute a subscription or guarantee future enrollment.

7. Refunds & Returns

7.1 General Policy

All sales are final. Maja Trading Card House does not accept returns or issue refunds on completed purchases except as outlined in this section or as required by applicable law.

7.2 Damaged Items

If your order arrives damaged, you must contact us within 7 calendar days of the delivery date with your order number, photographs of the damaged packaging, and photographs of the damaged contents. Upon review and approval, we will offer a replacement or refund at our sole discretion.

7.3 Lost Packages

If your package is confirmed lost by USPS in accordance with our Shipping Policy, we will offer a replacement or refund at our sole discretion. Packages marked as delivered by USPS are not considered lost.

7.4 Subscription Boxes

All subscription box sales are final. No refunds, exchanges, or returns will be accepted on shipped or picked up subscription boxes under any circumstances except as outlined in Section 7.2.

7.5 Collection Buyouts

All collection buyout transactions are final once payment has been issued to the seller. Maja Trading Card House does not accept the return of purchased collections after a buyout has been completed.

7.6 Chargebacks

If you initiate a chargeback with your bank or payment provider for a transaction that does not qualify for a refund under these Terms, Maja Trading Card House reserves the right to dispute the chargeback, suspend or terminate your account, and pursue any available legal remedies.

8. Collection Buyouts

8.1 Buyout Process

Maja Trading Card House purchases Magic: The Gathering collections from individuals. All offers made by Maja Trading Card House for collection buyouts are made in good faith based on our assessment of current market values at the time of the offer. Offers are not guaranteed until accepted by both parties in writing.

8.2 Offer Validity

Buyout offers are valid for 7 calendar days from the date of the offer unless otherwise specified. Market conditions may cause offer amounts to change after the validity period expires.

8.3 Final Sales

Once a buyout transaction has been completed and payment issued, the transaction is final. Maja Trading Card House takes full ownership of all purchased cards and collections upon completion of payment. Sellers may not reclaim cards or collections after a buyout is completed.

8.4 Seller Representations

By submitting a collection for buyout, you represent and warrant that you are the lawful owner of all cards and items submitted, that you have the legal right to sell them, and that the items are free of any liens, claims, or encumbrances. Maja Trading Card House is not responsible for purchasing stolen property and reserves the right to cooperate with law enforcement if stolen property is suspected.

9. Intellectual Property

9.1 Our Content

All content on majatcghouse.com including but not limited to text, graphics, logos, images, product descriptions, and website design is the property of Maja Trading Card House and Legend Entertainment or its content suppliers and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without our express written permission.

9.2 Third-Party Intellectual Property

Magic: The Gathering and all related card names, artwork, and intellectual property are the property of Wizards of the Coast LLC. Maja Trading Card House is an independent reseller and is not affiliated with, endorsed by, or sponsored by Wizards of the Coast LLC. All trademarks referenced on our website belong to their respective owners.

9.3 User Content

By submitting photos, reviews, feedback, or any other content to Maja Trading Card House through our website, email, or social media, you grant us a non-exclusive, royalty-free, perpetual license to use, reproduce, and display that content in connection with our business and marketing activities.

10. Third-Party Platforms

Maja Trading Card House operates on third-party platforms including Whatnot and TCGplayer. Your use of these platforms is governed by their respective terms of service and privacy policies. Maja Trading Card House is not responsible for the policies, practices, or actions of any third-party platform. We are not liable for any disputes, losses, or damages arising from your use of third-party platforms.

11. Prohibited Activities

By using our services you agree not to:

Use our website or services for any unlawful purpose or in violation of any applicable law
Engage in fraudulent activity including but not limited to providing false payment information or misrepresenting the ownership of cards submitted for buyout
Attempt to gain unauthorized access to our website, systems, or customer data
Use automated tools, bots, or scrapers to access or collect data from our website
Harass, threaten, or harm our staff, employees, or other customers
Submit chargebacks for transactions that do not qualify for a refund under these Terms
Resell subscription box contents in a manner that misrepresents their origin
Attempt to circumvent our enrollment caps or subscription policies
Post false, misleading, or defamatory reviews or content about our business

Violation of any prohibited activity may result in immediate account termination and may subject you to legal liability.

12. Disclaimer of Warranties

OUR WEBSITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MAJA TRADING CARD HOUSE AND LEGEND ENTERTAINMENT DISCLAIM ALL WARRANTIES INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT OUR WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT THE RESULTS OBTAINED FROM THE USE OF OUR SERVICES WILL BE ACCURATE OR RELIABLE.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MAJA TRADING CARD HOUSE AND LEGEND ENTERTAINMENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR ANY OTHER INTANGIBLE LOSSES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR SERVICES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 30 DAYS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100.00 USD).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

14. Indemnification

You agree to indemnify, defend, and hold harmless Maja Trading Card House, Legend Entertainment, and their respective officers, directors, employees, agents, and representatives from and against any claims, liabilities, damages, losses, costs, and expenses including reasonable attorneys' fees arising out of or in any way connected with your access to or use of our services, your violation of these Terms, your violation of any third-party rights, or your submission of false or fraudulent information.

15. Governing Law & Dispute Resolution

15.1 Governing Law

These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions.

15.2 Dispute Resolution

In the event of a dispute arising from these Terms or your use of our services, you agree to first contact us at majatcghouse.com and attempt to resolve the dispute informally. We will make reasonable efforts to resolve disputes within 30 days of receipt.

15.3 Jurisdiction

If informal resolution is unsuccessful, you agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in Wyoming. You consent to the personal jurisdiction of such courts.

15.4 Waiver of Class Action

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST MAJA TRADING CARD HOUSE OR LEGEND ENTERTAINMENT.

16. Changes to These Terms

Maja Trading Card House reserves the right to modify these Terms at any time. When we make material changes, we will update the Effective Date at the top of this page and where appropriate notify you by email or prominent notice on our website. Your continued use of our services following the posting of updated Terms constitutes your acceptance of the changes. We encourage you to review these Terms periodically.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

18. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and individual subscription Plan Policies, constitute the entire agreement between you and Maja Trading Card House with respect to your use of our services and supersede all prior agreements, understandings, and representations.
